Injunction Denied In Tyco Trachea Tube Patent Case

Law360, New York (July 8, 2009, 12:00 AM EDT) -- The judge in a patent case filed by Kimberly-Clark Worldwide Inc. has denied the company's request for an injunction barring Tyco Healthcare Group LP from selling endotracheal tubes designed to minimize infections that can lead to pneumonia in patients hooked up to ventilators.

Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin ruled Monday that issuing an injunction would not be in the public interest because it involves sensitive medical equipment.
