With MTBE Trial Near, Exxon Keeps Up NYC Fight

Law360, New York (July 09, 2009, 12:00 AM ET) -- With about three weeks to go until the start of a trial over the gasoline additive methyl tertiary-butyl ether, last remaining defendant Exxon Mobil Corp. has filed another motion for summary judgment against the city of New York.

A technical memo drafted by a consultant in 1999 sinks New York's claims as time-barred because it shows the city knew in advance the problems posed by MTBE, Exxon said in a motion filed Wednesday in the U.S. District Court for the Southern District of New York....
