Tyson Denied Bid To Postpone Poultry Waste Trial

Law360, New York (July 9, 2009, 12:00 AM EDT) -- Tyson Foods Inc. has lost its bid to push back a September trial accusing several poultry producers of polluting Oklahoma’s Illinois River.

In a Wednesday minute order, Judge Gregory K. Frizzell of the U.S. District Court for the Northern District of Oklahoma denied the company's motion for a continuance of trial.

Tyson claimed that postponing the Sept. 21 trial date would “promote the efficient resolution of this case,” arguing that it would allow the court more time to resolve the parties’ summary judgment and Daubert motions....
