Sandoz Loses Bid For Attys' Fees In Lovenox Spat

Law360, New York (July 13, 2009, 12:00 AM EDT) -- A federal judge has shot down an attempt by generic-drug maker Sandoz Inc. to obtain attorneys’ fees and costs in an infringement suit brought against it by Sanofi-Aventis units over patents covering anti-clotting drug Lovenox that ended up being invalidated due to inequitable conduct.

Judge Mariana R. Pfaelzer of the U.S. District Court for the Central District of California on Friday held that Sandoz had failed to meet its burden that the consolidated case was exceptional and refused to award legal fees to the defendant....
