Lead In Lead Pigment Not Design Defect: Wis. Court

Law360, New York (July 14, 2009, 12:00 AM EDT) -- Ruling that a product's characteristic ingredient cannot constitute a claim of defective design, the Wisconsin Supreme Court has affirmed a lower court's dismissal of strict liability and negligence claims against white lead carbonate pigment manufacturers including the Sherwin-Williams Co. and DuPont Co.

The court on Tuesday affirmed a circuit court's ruling that the complaint had failed to allege a design feature that rendered defective the design of white carbonate lead pigment, which can be found in white paint.
