LSI Fights Ch. 15 Stay Of ITC's Qimonda Probe

Law360, New York (July 15, 2009, 12:00 AM EDT) -- LSI Corp. and Agere Systems Inc. have challenged a bankruptcy court’s decision to halt the U.S. International Trade Commission’s investigation of struggling chip maker Qimonda AG, claiming the inquiry over Qimonda’s alleged patent infringement is a regulatory proceeding and thus exempt from an automatic stay.

Deeming the bankruptcy court’s automatic stay provision inapplicable, chip designer LSI and its subsidiary Agere filed a motion Tuesday urging the ITC to strike the bankruptcy court’s stay and allow the investigation of Qimonda to continue.
