Wis. Court Opens Door To Wind Energy

Law360, New York (July 16, 2009, 1:12 PM EDT) -- A Wisconsin state appeals court has ruled that local governments must consider alternative energy systems such as wind turbines on a case-by-case basis and can only restrict them to protect public health or safety.

The ruling Wednesday by the Wisconsin Court of Appeals held that because state laws disfavor wholesale local control over alternative energy systems, local governing arms must first hear the specifics of the particular wind system and then decide whether a restriction is warranted.
