Oticon Drops Vivatone From Hearing Aid IP Suit

Law360, New York (July 17, 2009, 1:43 PM ET) -- After perusing the software source code for its rival's digital hearing aids, Oticon Inc. has dropped infringement allegations against Vivatone Hearing Systems LLC, but maintained claims against SeboTek Hearing Systems LLC.

On Thursday, Oticon asked Judge Freda L. Wolfson of the U.S. District Court for the District of New Jersey to let Vivatone exit the arena.

The plaintiff’s ardor for litigation was chilled after reviewing the source code for Vivatone’s Entre model hearing aids and other allegedly infringing products, according to court filings.
