RICO, ERISA Claims Survive In Pa. Hospital OT Action

Law360, New York (July 21, 2009, 2:57 PM EDT) -- A federal judge has declined to dismiss claims under the Racketeer Influenced and Corrupt Organizations Act and the Employee Retirement Income Security Act in one of three suits challenging meal break policies at a Pittsburgh-area hospital system, but ordered the plaintiffs to file an amended complaint clarifying their claims.
