1st Amendment Doesn't Shield Cops' Speech: 9th Circ.

Law360, New York (July 23, 2009, 7:18 PM EDT) -- Two former police officers who participated in police corruption probes in Pittsburg, Calif., can't seek First Amendment protection from retaliation, a U.S. appeals court has affirmed, reasoning the constitution protects public officials only when they speak out as private citizens.

A 2-1 majority of the U.S. Court of Appeals for the Ninth Circuit on Tuesday affirmed a summary judgment ruling dismissing the case, finding the officers spoke out pursuant to their jobs and were therefore ineligible for First Amendment protection.
