Class Cert. Sought In FLSA Suit Against Pepsi

Law360, New York (July 24, 2009, 4:00 PM EDT) -- An employee of Pepsi Bottling Group Inc. is seeking class certification in a suit alleging Pepsi is violating the Fair Labor Standards Act by failing to pay sales employees for overtime work.

David Stuck filed the motion Thursday in the United States District Court for the Northern District of Ohio Western Division on behalf of approximately 11 to 15 others also employed as large format area sales managers at the Lima, Ohio facility within the past three years.
