Mass. High Court Greenlights Doctor's Sex Bias Suit

Law360, New York (July 28, 2009, 6:37 PM EDT) -- Massachusetts' highest court has ruled that an anesthesiologist suing her employers for sex discrimination isn't bound to an arbitration clause in her employment contract, finding that such clauses must specify that they apply to statutory discrimination claims.

The Massachusetts Supreme Judicial Court affirmed Monday that Carol A. Warfield, former chief of anesthesiology at Beth Israel Deaconess Medical Center Inc., can pursue discrimination and retaliation claims against her employers.
