9th Circ. Denies Challenge To Nuclear Threat Rule

Law360, New York (July 29, 2009, 4:57 PM EDT) -- A federal appeals court has dismissed several public interest groups' challenge to a U.S. Nuclear Regulatory Commission rule defining what threats nuclear facilities must protect against, ruling that the NRC was within its authority to exclude requirements compelling licensees to guard against air attacks.
