CalPERS Denied Bid To Appeal Lead Plaintiff Status

Law360, New York (July 31, 2009, 4:46 PM EDT) -- A federal judge overseeing securities litigation stemming from Bank of America Corp.'s $50 billion acquisition of Merrill Lynch & Co. has denied a bid to seek appeal of an order granting lead plaintiff status to a group of five public pension funds.

The California Public Employees' Retirement System had sought a pre-motion conference to discuss moving for certification of the order for interlocutory appeal, but Judge Denny Chin of the U.S. District Court for the Southern District of New York denied certification Thursday.
