W.Va. High Court Eyes Judge In Massey Case

Law360, New York (July 31, 2009, 6:43 PM EDT) -- The West Virginia Supreme Court has reportedly ordered an investigation into allegations regarding a circuit judge's allegedly improper behavior in a water pollution case against Massey Energy Co.

Chief Justice Robin Davis said Thursday that while most of the charges raised by the plaintiffs in the case appear insufficient to warrant the disqualification of Mingo County Circuit Judge Michael Thornsbury, a hearing must be held on how a multimillion-dollar medical monitoring trust fund will be handled, the Associated Press reported.
