USPTO Preliminary Finding Rejects TiVo DVR Patent

Law360, New York (August 04, 2009, 6:09 PM ET) -- Dish Network Corp. has scored a victory in its ongoing feud with TiVo Inc. over digital video recorder technology, with the U.S. Patent and Trademark Office issuing a preliminary finding that a patent previously upheld by a federal court is invalid.

In an initial office action handed down on Monday, the USPTO determined that two prior patents rendered claims 31 and 61 of U.S. Patent Number 6,233,389, TiVo's so-called Time Warp patent, obvious.
