Judgment On Eye-Treatment Inventorship Reversed

Law360, New York (October 9, 2006, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit on Friday overturned a lower court’s finding that the founder of Canada’s QLT Inc. was a joint inventor of the Visudyne eye treatment, whose patent is held by the Massachusetts Eye & Ear Infirmary.

“Because we conclude that there are general issues of material fact with regard to whether Levy made a significant contribution … we reverse the grant of partial summary judgment and remand for further proceedings,” the court of appeals wrote in its decision....
