BASF Must Produce Non-US Docs In Urethane MDL

Law360, New York (August 13, 2009, 12:50 PM EDT) -- A magistrate judge has ordered BASF Corp., Huntsman International LLC and the Dow Chemical Co. to produce documents related to commerce outside the U.S., in the multidistrict litigation over an alleged antitrust conspiracy in the urethane market.

Magistrate Judge James P. O'Hara of the U.S. District Court for the District of Kansas on Wednesday ruled that a liberal discovery approach to documents discussing purely foreign activities has been followed by a number of other courts that have addressed the issue in the domestic antitrust context....
