Court Rules Firefighter Age Limits Unconstitutional

Law360, New York (August 13, 2009, 6:46 PM EDT) -- The Montana Supreme Court has ruled a county violated an aspiring firefighter's constitutional rights by refusing to hire him due to his age.

The ruling, however, proves a mixed bag for Steven Jaksha, the 38-year-old would-be fireman who has fought since 2006 to gain employment on the county's fire department. While the decision represents a significant public policy change by declaring an age limit statute unconstitutional, Jaksha, himself, cannot gain employment due to procedural barriers.
