Rite Aid, CVS File New HIV Drug Price Complaint

Law360, New York (August 14, 2009, 2:44 PM ET) -- Rite Aid Corp., CVS Pharmacy Inc. and several other pharmacy chains have filed a second amended complaint in their antitrust action against Abbott Laboratories alleging the drugmaker illegally jacked up the prices of its market-dominating HIV medications, following an appeals court ruling that a similar class action against Abbott failed to state a valid claim in light of recent case law.
