GSK Sues Glenmark Over Malarone Patents

Law360, New York (August 17, 2009, 12:03 PM EDT) -- GlaxoSmithKline PLC has hit Glenmark Generics Inc. USA with a patent infringement suit over its application to manufacture and market a generic version of malaria prophylactic Malarone.

In a complaint filed Friday in the U.S. District Court for the District of Delaware, GSK alleges that Glenmark has infringed three patents related to the drug.

The patents-in-suit are U.S. Patent Numbers 6,166,046, “Combination of atovaquone with proguanil for the treatment of protozoal infections,” issued on Dec. 26, 2000; 6,291,488, “Preventing protozoal infections,” issued on Sept. 18, 2001;...
