DOC Staff Shortage Doesn't Excuse Missed Work: Judge

Law360, New York (August 20, 2009, 2:07 PM EDT) -- The U.S. Department of Commerce cannot use staff problems as an excuse to shirk work, the U.S. Court of International Trade has ruled in a case over Chinese honey dumping duties.

Commerce must individually assess the anti-dumping duty margins for Chinese honey exporter Zhejiang Native Produce & Animal By-Products Import & Export Corp., Chief Judge Jane A. Restani said in an Aug. 19 order granting the company's motion for a judgment on the agency record.
