LM Aims To Nix Roush Suit Over Workers' Comp Fees

Law360, New York (August 24, 2009, 6:36 PM EDT) -- LM Insurance Corp. is aiming to derail Roush Fenway Services LLC’s suit alleging the insurer has overcharged the race car company about $2.5 million in premiums for workers’ compensation insurance since 2007.

LM Insurance and parent Liberty Mutual Insurance Co. filed a motion to dismiss the suit Friday in the U.S. District Court for the Middle District of North Carolina, claiming Roush lacked subject matter jurisdiction because it failed to take the dispute to the proper state authorities before suing.
