No Appeals Based On 'Death Knell Doctrine': Court

Law360, New York (August 24, 2009, 7:31 PM EDT) -- Arizona's high court has ruled that a truck driver suing Swift Transportation Co. Inc. cannot appeal an order denying him class certification, citing U.S. Supreme Court doctrine concluding that such orders can be amended anytime and thus are not appealable.

The Arizona Supreme Court decided unanimously on Monday to vacate a ruling by the state's First Division Court of Appeals overturning a denial of class certification.
