10th Circ. Strips Novell Of Unix Copyright

Law360, New York (August 25, 2009, 7:55 PM EDT) -- Computer infrastructure company Novell Inc. and bankrupt rival the SCO Group Inc. are headed back to district court to resolve their copyright dispute over ownership of the Unix operating system, following a federal appeals court’s reversal of a decision granting ownership of the copyright to Novell.

The U.S. Circuit Court of Appeals for the Tenth Circuit on Monday reversed an August 2007 summary judgment ruling by District Judge Dale A. Kimball that found Novell alone owned the rights to the Unix copyright, remanding the dispute....
