Fund Relaunches Trasylol Class Action Against Bayer

Law360, New York (September 11, 2009, 3:36 PM EDT) -- A Tennessee benefits fund has taken another shot at filing a proposed class action against Bayer Corp. over alleged fraud in the marketing of the lucrative blood-clotting drug Trasylol, just weeks after a federal judge threw out an earlier complaint.

Seeking to correct faults that led Judge Donald Middlebrooks to dismiss an amended complaint in July, the Southeast Laborers Health & Welfare Fund filed a second amended complaint Sept. 10 in the U.S. District Court for the Southern District of Florida.
