Judge Denies Roche's Motion To Dismiss Amgen Suit

Law360, New York (October 20, 2006, 12:00 AM EDT) -- Drug maker Roche Holding AG lost its bid Friday to have biotechnology giant Amgen Inc.’s high-profile patent infringement lawsuit over blockbuster anemia drug Epogen dismissed.

The Swiss pharmaceutical firm filed the motion to dismiss the case in April, arguing that Amgen, based in Thousand Oaks, Calif., had failed to state a claim and that its complaint lacked subject matter jurisdiction.
