Micron Seeks To Trim Claims In Drug Contract Spat

Law360, New York (September 15, 2009, 7:00 PM ET) -- Micron Technologies Inc. has asked a federal judge to dismiss allegations of deceit, unjust enrichment and state trade practice violations in a breach of contract suit brought by Armstrong Pharmaceuticals Inc. accusing Micron of failing to properly micronize two batches of albuterol for use in Armstrong's inhalers.

Micron filed its motion to dismiss Monday in the U.S. District Court for the District of Massachusetts, requesting that three of the six counts in Armstrong's July 14 complaint be thrown out in order to “narrow properly the complaint.”...
