CIT Judge Won't Rehear Uranium Dumping Case

Law360, New York (September 15, 2009, 7:57 PM EDT) -- A judge has refused the request of a group of U.S. nuclear utility companies to have a rehearing in a case challenging the U.S. Department of Commerce's decision not to alter its agreement restricting the importation of enriched uranium from the Russian Federation.

In a decision Tuesday, Judge Donald C. Pogue of the U.S. Court of International Trade said he wouldn't rehear the dismissal of the action for lack of standing because the case was correctly dismissed.
