KBR Worker's Rape Case Not Arbitrable: 5th Circ.

Law360, New York (September 16, 2009, 7:07 PM EDT) -- A former Halliburton Co. clerical worker who claims her co-workers gang-raped her in company-provided barracks in Iraq can sue the defense contractor for negligence, a U.S. appeals court has ruled, reversing a federal judge's decision to partly compel arbitration.

The U.S. Court of Appeals for the Fifth Circuit ruled in favor of former contractor Jamie Leigh Jones Sept. 15 in a 2-1 decision, finding her alleged assault was not related to her employment and therefore was not subject to her contract's arbitration provision.
