9th Circ. Agrees MGA's Bratz Don't Infringe Copyright

Law360, New York (September 16, 2009, 7:28 PM EDT) -- A federal appeals court has upheld a district court's ruling that airbrush art business Art Attacks Ink LLC lacked evidence to prove trade dress and copyright infringement by Bratz doll maker MGA Entertainment Inc.

A three-judge panel in the U.S. Court of Appeals for the Ninth Circuit affirmed Wednesday that Art Attacks, a small, California-based, family-owned operation, failed to prove copyright infringement because it offered no convincing evidence that MGA personnel had access to its designs.

The characters in question were Art Attacks' "Spoiled Brats" designs...
