Lawmakers Take Aim At Insurer Antitrust Exemptions

Law360, New York (September 17, 2009, 6:31 PM ET) -- Legislation that would remove federal antitrust exemptions for health and medical malpractice insurers through a surgical repeal of the McCarran-Ferguson Act was introduced in both chambers Thursday.

While Congress gears up for debate on comprehensive health care reform, the Health Insurance Industry Antitrust Enforcement Act would provide consumers — whose coverage costs continue to rise — with the confidence that insurance companies are operating in the same, competitive marketplace as other industries, said Judiciary Committee chairman Patrick Leahy, D-Vt.,who brought the bill to the Senate....
