Fed. Circ. Grants Nalco Stay In Baker Hughes Spat

Law360, New York (September 18, 2009, 6:21 PM EDT) -- Nalco Holding Co. has won an administrative stay of an injunction that had barred it from testing a crude oil refining process in an ongoing patent infringement lawsuit brought by rival Baker Hughes Inc.

The U.S. Court of Appeals for the Federal Circuit issued the stay in a brief order Sept. 16, giving Baker Hughes seven calendar days to file a response.

The U.S. District Court for the Southern District of Texas on Sept. 11granted Baker Hughes the preliminary injunction it had requested.
