Citing SLUSA, 6th Circ. OKs Toss Of Securities Suit

Law360, New York (September 18, 2009, 4:22 PM EDT) -- A federal appeals court has affirmed the dismissal of a putative class action securities and breach of contract case accusing Fifth Third Bank NA of putting its own interests before those of people whose estates, wills, trusts and other funds it managed.

In an opinion issued Sept. 17 in the U.S. Court of Appeals for the Sixth Circuit, a panel of judges discussed the application of the Securities Litigation Uniform Standards Act of 1998 in agreeing with a March 2008 ruling that dismissed the complaint....
