Pella Asks Court To Reassess Liberty Bad Faith Claim

Law360, New York (September 21, 2009, 4:50 PM EDT) -- Pella Corp. has asked a federal judge to reconsider an order denying its counterclaims that Liberty Mutual Insurance Co. acted in bad faith by denying defense costs in underlying litigation that accused Pella of manufacturing defective windows.

Pella’s motion for reconsideration, filed Friday in the U.S. District Court for the Southern District of Iowa, claimed the district court’s Aug. 23 decision granting Liberty Mutual’s motion for summary judgment was “clearly or manifestly erroneous.”
