ANI Wants Pollution Insurance Ruling Reconsidered

Law360, New York (September 28, 2009, 2:02 PM EDT) -- American Nuclear Insurers has asked a federal judge to reconsider a Sept. 15 decision finding that the insurer has a duty to defend two companies the U.S. Environmental Protection Agency ordered to clean up radiation pollution at a Superfund site.

ANI filed its motion for reconsideration Sept. 25, saying Judge Richard Stearns of the U.S. District Court for the District of Massachusetts misread the insurance policy when he granted summary judgment to plaintiffs Whittaker Corp. and Textron Inc.
