Law360, New York (September 28, 2009, 4:05 PM ET) -- CVS Pharmacy Inc., Walgreen Co., Wal-Mart Stores Inc. and others have asked a judge to dismiss a proposed class action accusing them of overcharging for generic drugs by not passing along discounts to consumers.
In a motion filed Friday in the U.S. District Court for the District of Minnesota, the defendants said employee health funds Graphic Communications Local 1B Health & Welfare Fund "A" and the Twin Cities Bakery Drivers Health and Welfare Fund had failed to plead sufficient facts.
