CIT Designates Test Case For VW Duties Spat

Law360, New York (September 28, 2009, 5:53 PM EDT) -- The U.S. Court of International Trade has agreed to suspend a number of lawsuits against Volkswagen of America Inc. over duty allowances for vehicle defects so that a single suit can serve as a test case.

Judge Richard W. Goldberg on Monday suspended 29 suits and designated the most recent as a test case.

Attorney Thomas J. Kovarcik, who represents VW in the matter, said the U.S. government did not oppose the automaker's motion for the test case and the development was expected.
