Albion Drops Supplement Patent Suit Against Seton

Law360, New York (September 29, 2009, 1:46 PM EDT) -- Utah-based Albion Laboratories Inc. has dropped its suit alleging Seton Pharmaceuticals LLC’s sale of iron supplements for the treatment of anemia infringed its patent and violated the Lanham Act.

The U.S. District Court for the Southern District of Florida on Monday granted a bid by Albion and its licensed generics distributor, Breckenridge Pharmaceutical Inc., to dismiss their suit with prejudice and closed the case just a little over two months after it was filed against Seton and its distributor, Granard Pharmaceuticals Sales & Marketing LLC....
