Most Claims Survive In MetroPCS, Virgin Mobile Spat

Law360, New York (September 29, 2009, 3:31 PM EDT) -- A federal judge has kept the bulk of the claims alive in a trademark and contract fight between MetroPCS Wireless Inc. and Virgin Mobile USA LP over a MetroPCS service that reconfigures mobile phones to work on its wireless network.

In an opinion Friday, Chief Judge Sidney A. Fitzwater of the U.S. District Court for the Northern District of Texas said that there were several issues in the case that should go forward.
