Motor Carrier Act Lets Recycler Off FLSA Hook: Judge

Law360, New York (October 5, 2009, 4:55 PM EDT) -- A federal judge has ruled that the Motor Carrier Act, which applies to workers involved in interstate commerce, exempts Ray's Trash Service Inc. drivers from the Fair Labor Standards Act even though those drivers don't cross state lines.

Judge Richard L. Young of the U.S. District Court for the Southern District of Indiana dismissed the FLSA suit against Ray's, finding that the MCA applied to the drivers because the recyclables they transported eventually crossed state lines.
