CIT Tosses Funai Digital TV Suit Against US, CBP

Law360, New York (October 6, 2009, 7:09 PM EDT) -- The U.S. Court of International Trade has thrown out a suit by Funai Electric Co. Ltd. challenging a ruling by U.S. Customs and Border Protection to allow digital televisions made by rival Vizio Inc. and others into the country, allegedly in violation of an exclusion order.

Granting the government's motion to dismiss Funai's complaint was all that clearly lay within the court's jurisdiction in the matter, the CIT ruled Tuesday.
