Whirlpool Gets Fraud Claims Tossed In Contract Spat

Law360, New York (October 7, 2009, 5:24 PM EDT) -- Whirlpool Corp. has won a dismissal of fraud claims in a dispute in which Whitesell Corp. alleges it did not receive all the business opportunities it was promised under a contract to sell fasteners to the washing machine maker.

Judge Robert Bell of the U.S. District Court for the Western District of Michigan tossed Whitesell's fraud claims against Whirlpool on Monday, saying the contract's no-reliance clause and the economic loss doctrine precluded the allegations.
