Shrimp Cos. Fail To Lift Injunction On Duties Decrease

Law360, New York (October 8, 2009, 12:39 PM EDT) -- Two foreign shrimp exporters have lost their bid to lift a preliminary injunction barring the U.S. government from assessing lowered anti-dumping duties on frozen warmwater shrimp from India.

Judge Donald C. Pogue of the U.S. Court of International Trade on Tuesday denied Devi Sea Foods Ltd. and Falcon Marine Exports Ltd.'s motion to lift the preliminary injunction.

The foreign shrimp exporters, which intervened as defendants on Aug. 20, aren't entitled to “relitigate issues already decided prior to their intervention,” according to Judge Pogue, who imposed the...
