Rite Aid Moves To Dismiss ‘Redundant’ OT Suit

Law360, New York (October 9, 2009, 2:24 PM EDT) -- Rite Aid Corp. has moved to dismiss a putative overtime class action filed by a former drugstore employee, saying it is identical to another class action filed earlier.

Rite Aid says federal law gives precedence to the first filed action, arguing that the case filed by Bronx, N.Y., ex-employee Georgianna Gordon in the U.S. Southern District of New York should be dismissed.

Indergit v. Rite Aid Corp. and Rite Aid of New York Inc. was filed 10 months before the Gordon suit, according to the drugstore....
