Supreme Court Denies Ferring B.V.'s Petition

Law360, New York (November 1, 2006, 12:00 AM EST) -- The U.S. Supreme Court has refused to hear an appeal from Dutch drug maker Ferring B.V., dashing its hopes for restoring a patent for a rare hormone deficiency treatment and raising concerns that inequitable conduct rules will be abused to invalidate patents.

“The problem isn’t going to go away and the Supreme Court will have to address it eventually,” said Richard Samp, chief counsel for the Washington Legal Institute, which filed an amicus brief in support of the appeal.
