Justices Air Concerns Over Class Notification Costs

Law360, New York (October 13, 2009, 6:42 PM EDT) -- Justice Sonia Sotomayor has signed onto her first opinion at the U.S. Supreme Court, joining two other justices in a brief note expressing due process concerns about a lower court's ruling requiring a dating service to pay the cost of notifying class members in a suit against it.

The Supreme Court denied certiorari in the case, and Justice Anthony Kennedy, while agreeing with that decision, issued a statement noting that the suit “does implicate issues of constitutional significance.” Justice Sotomayor and Chief Justice John Roberts joined...
