Law360, New York (October 15, 2009, 7:35 PM ET) -- The judge overseeing a proposed “donning and doffing” class action against Butterball LLC has sided against one of the production line workers, dismissing a Missouri case that accused the poultry producer of violating the Fair Labor Standards Act.
On Wednesday U.S. District Judge Richard Dorr granted summary judgment to Butterball in the case brought by plaintiff Janice Hudson on behalf of herself and others similarly situated, while shooting down her request for class certification.
