Teva Found To Infringe Alcon Vigamox Patent

Law360, New York (October 20, 2009, 6:24 PM EDT) -- Alcon Inc. emerged victorious Tuesday from a three-year tussle with generic-drug maker Teva Pharmaceuticals USA Inc. over a patent related to the anti-bacterial drug Vigamox.

Judge Sue Robinson of the U.S. District Court for the District of Delaware entered judgment in favor of Alcon and Alcon Research Ltd. and against Teva.

On Monday, she issued an opinion that Alcon proved “by a preponderance of evidence” that Teva's generic product infringed the patent-in-suit, and that Teva had failed to prove that the patent-in-suit is invalid.
