Cable Co. Wants Set-Top Box Tying Suit Nixed

Law360, New York (October 26, 2009, 6:31 PM EDT) -- Insight Communications Co. LP has asked a federal judge to dismiss a putative class action accusing the cable provider of violating federal antitrust laws by tying its premium cable services to its set-top box rentals.

The motion to dismiss, filed Friday in the U.S. District Court for the Western District of Kentucky, argues that the plaintiffs have failed to meet the pleading requirements under Twombly to sustain their amended complaint.
